Friel Welch is appointed as Contract Administrator across the suite of JCT contracts, alongside the bespoke amendments we draft and review. Our team carries the contractual duties the role requires. Issuing instructions, certifying payments, agreeing extensions of time, valuing variations, and certifying practical completion and the final account. The role is performed with the impartiality the contract requires and the commercial awareness the client deserves, by a team experienced enough to make decisions promptly and defend them with evidence.

Contract Administration is the one role on a project that comes with an enforceable duty of impartiality. That duty is the role. We take it seriously, and we take it as the protection it is for the client rather than a constraint on the position we hold. Friel Welch assess each instruction, each variation, each claim, and each application against the contract and the evidence in front of us, and certifying the outcome the contract requires. The client is entitled to a Contract Administrator who can be relied on by both sides, because that is the CA the client paid for.
A natural bolt-on for architectural practices
As the role’s technical demands have grown, the commercial exposure has grown with them, and the risk profile has shifted in ways many architectural practices no longer wish to carry on their own PI. It is one of several shifts we are watching across the industry, as practices and developers recalibrate the services they offer and the services they retain against the realities of how schemes now get delivered. Friel Welch sits naturally alongside the architect in those conversations, picking up the formal CA appointment while the practice retains design leadership and the client relationship. We work in the architect’s rhythm, attend the design team meetings, and keep the language consistent across the design and contractual outputs.
Calibrated to the contract
The right JCT form for a project is not always the one used last time. Our team works across the full suite of JCT contracts, selecting the form against the procurement strategy and the design maturity of the scheme, then drafting the amendments the project actually needs. The contract is shaped to protect the client’s position without inviting disputes the contract itself has created. Where a project sits within an existing client framework or a contractor’s preferred form, we review it on its merits, recommend amendments where they earn their place, and flag the clauses worth pushing back on before they reach execution.
Defensible decisions made promptly
Slow contract administration create more disputes than it resolves. Instructions issued late lose the programme. Variations valued late accumulate. Extensions of time decided late become claims for loss and expense. Our team holds the contractual decisions to the timescales the contract sets. Each certificate, each instruction, and each determination is written so a third party reading it cold can see what was decided, why it was decided, and what evidence supported it. Disputes are easier to avoid than to win.

Similarities to Employer’s Agent
Contract Administration and Employer’s Agent share several duties, and both become active once the contract is in place. They are often confused and the procurement route is what separates them. On traditional procurement, where the design responsibility sits with the Employer and the design team, the role is Contract Administration. On JCT Design and Build, where design responsibility transfers to the contractor, the role consolidates with the Employer’s commercial representation into a single Employer’s Agent appointment.
